Paid crew members on vessels registered in the United States are covered by the Jones Act, a law that covers seamen and certain other maritime workers for injuries sustained on the job, including compensation for:

  • “Maintenance and cure" – the financial equivalent of the room and board a seaman would normally receive at sea;
  • Medical treatment.

If you can prove negligence on the part of an equipment manufacturer or the owner of an unseaworthy boat, you may also be able to file claims for additional damages not covered by the Jones Act, including lost wages. An unseaworthy boat is a vessel not suited for its intended function – either because the boat itself has defects or is inadequately equipped for the job. unseaworthiness can have serious consequences, including sinking or explosions – and the crew members pay the ultimate price.
